ARTIST AGREEMENT

 

THIS AGREEMENT is entered into this___ day of  ______ , 2004, by and between Xavier Cortada, Inc,.a Florida Corporation, hereinafter referred to as "ARTIST," and ___________________, a non-profit Corporation, having its principal place of business in ____________ referred to as "CONTRACTOR."

In consideration of the mutual promises and covenants herein, the parties hereto agree as follows:

SCOPE OF WORK

THE ARTIST:

  • The ARTIST will produce a multi-panel collaborative movable mural during the __________  ___________       Conference in _________________ , _____ from ________________ , 2005 to _________, 2005.
     

  • The ARTIST retains full rights to the art work created.

·         Prior to the Conference, ARTIST will work with CONTRACTOR to select themes, concepts and idea for mural

·         The ARTIST will introduce the mural concept during the opening event (e.g.: plenary or meeting)

·         The ARTIST will work with participants to develop individual messages

·         The ARTIST will incorporate/collage participant's messages into the mural's background

·         The ARTIST will create a 48" x 108" mural painting capturing the selected theme

·         The ARTIST will unveil and sign the finished mural during the closing event

·         The ARTIST will participate in media interviews.

THE CONTRACTOR:

  • Prior to and during the conference, the CONTRACTOR will promote the mural project and feature artist Xavier Cortada and website (www.cortada.com) in Conference publications and press releases,
     

  • The CONTRACTOR will take possession and ownership of the finished mural.
     

  • The CONTRACTOR will take all reasonable precautions to ensure that the artwork is preserved and remains in the public trust for future generations of Americans to enjoy.  The artwork will be displayed with the following label:

    "Xavier Cortada, "[Title of the work]", mixed media on canvas, 48" x 108", 2002, (www.cortada.com).

  • The CONTRACTOR will provide the ARTIST with a professional photographic image of the finished mural (4" x 5" transparency and 50 megabyte digital format).
     

  • The CONTRACTOR will provide the ARTIST with photodocumentation and videodocumentation of the mural's creation and unveiling.

FEE

The CONTRACTOR will pay the ARTIST $_____________  to produce the mural on three 4' x 3' panels of stretched canvas during the conference. The first half is due upon the executing of this contract, the latter half due at the conference's end (or shortly thereafter).  ARTIST will provide CONTRACTOR with invoice and Federal Identification number.

The CONTRACTOR will also pay for all reasonable expenses for room, board and travel for the ARTIST (Xavier Cortada) and one assistant.

Cortada was invited to meet with His Holiness John Paul II, and speak from the Bernini papal altar at St. Peter's Basilica during the Jubilee Day for Artists, The Vatican, Vatican City.
